Hotel Augusta General Terms and Conditions

Please send us your credit card number as a guaranty of your booking. These terms and conditions apply to the provision of lodging services, as well as to the provision of conference and banquet rooms for the organisation of events for all other related deliveries and services. They apply in the same way to the transfer of other rooms, showcases and places in event areas that are connected to the hotel.

The following terms and conditions apply exclusively. Terms and conditions on the part of the guest (uniform name for the organiser / customer / guest, etc.) are not part of the contract, even if this was not expressly contradicted.

1. Contractual Relationship
Reserving rooms and areas as well as agreeing to other deliveries and services is binding upon confirmation of the hotel for both parties or, if this is no longer possible due to lack of time, with the provision of accommodation. Reserving rooms, showcases and areas constitutes a leasing relationship. Sub-letting or re-letting as well as using hotel rooms for purposes other than residential purposes requires the written consent of the hotel. If the reservation is made by a third party, then they are liable for all liabilities arising from this contract in addition to the guest as a joint and several debtor, regardless of an effective authorisation of the guest or contracting party.

2. Arrival and Departure
Booked rooms are available to guests upon arrival from 2.00 p.m. and on the day of departuretag until 11.00 a.m. The specific rooms to be allocated to the guest are determined by the hotel on the day of arrival. The hotel is entitled to a cancellation right. Guests are kindly requested to inform the reception if they plan to leave the room after 11.00 a.m. by 6.00 p.m. at the latest on the day beforetag departure.

3. Prices
The prices are determined by the price list valid at the time the service is rendered. VAT is included in the prices. If the VAT increases after conclusion of the contract, this is charged to the guest. If a fixed price has been agreed and there are more than four months between the conclusion of the contract and when the guest arrives at the hotel, the hotel reserves the right to make a reasonable price change.

4. Payment Conditions
All hotel bills under this contract are due within 14 days of the date of invoice without deduction of payment. In any case, the hotel may request an advanced payment of a reasonable amount from the guest. If the previously mentioned payment period is exceeded, the guest will be in debt to the hotel without the need for a reminder. From the time the guest is indebted to the hotel, the hotel is entitled to demand interest for late payment in the amount of 4% above the respective discount rate of the Deutsche Bundesbank. We reserve the right to assert a claim in respect of any additional damage caused by delay. For reminders, which take place after the delay, a dunning charge of 10.00 euros may be demanded in each individual case.

5. Withdrawal and Cancellation
In the event of force majeure or other reasons for which the hotel is not responsible, in particular reasons that are outside the hotel’s sphere of influence, the hotel reserves the right to withdraw from the contract without the guest being entitled to compensation. Cancellation is only valid when made in writing. If the guest does not use the room they have reserved without informing the hotel 2 days in advance, they remain obligated to pay the agreed total price; for weekend bookings this shall be 2 days before arrival, regardless of reason for the cancellation. Cancellations and modifications to the booking are only free of charge 2 days in advance, for weekend bookings this shall only be free of charge 2 days before arrival, afterwards 80% of the total is amount due. For trade fairs as well as congress times or events, modifying or cancelling the reservation is only free of charge up to 2 days before arrival. After this 80% of the total will be charged and 1 day before the planned arrival this shall be 100%.

6. Liability
The hotel strives to make wake-up calls in good time, to ensure the timeliness and accuracy of communications as well as the timely delivery of goods of all kinds. Items left behind will only be sent to the guest at their request, risk and cost. Otherwise, after a one-month retention period, the items will be returned to the local lost property office and the guest shall be charged a reasonable fee.

8. General Information
An ineffective general business condition shall be immediately replaced by the parties with an effective one which comes closest to the ineffective provision in its legal and economic content. Deviations or secondary agreements require the written form. This also applies for revocation of this written form requirement. Verbal sub-agreements do not exist. The place of performance is the location of the hotel. In commercial transactions the legal venue is the location of the hotel. The laws of the Federal Republic of Germany shall apply exclusively.
